Binding Arbitration and Class Action Waiver

Except for disputes that qualify for small claims court and claims for injunctive or equitable relief relating to intellectual property, any dispute, claim, or controversy arising out of or relating to these Terms or the Site will be resolved by binding arbitration under the Federal Arbitration Act. The arbitration will be administered by a recognized arbitration provider under its applicable rules. The seat and venue of arbitration will be King County, Washington, and the language will be English. You and we agree to arbitrate on an individual basis only; class arbitrations and class actions are not permitted. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim.

Opt-Out

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending a notice to [email protected] with your name, the email address associated with your account (if any), and a clear statement that you wish to opt out of arbitration. If you opt out, you agree to the exclusive jurisdiction and venue of the state and federal courts located in King County, Washington.

Miscellaneous

These Terms constitute the entire agreement between you and us regarding the Site and supersede all prior or contemporaneous agreements on the subject matter. If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our rights.
